Registration Papers
Simply Southern Pups sell puppies on behalf of breeders in our closed network dog club. We are breeders first and began the club we created. There are situations in which we do not receive your pup's registration papers upon puppy acquisition. However, 99% of the time we have the registration papers within 14 days. There can be unusual situations in which the breeders are unable to provide us registration papers and/or the registration firm is backed up and will need extra time to send out paid registrations. In such cases we have no control on the outcome as we aren’t the actual breeder. If registration papers are very important to you, please call and verify we do have them prior to shipping your puppy or picking up. Most customers are buying for a family pet, so registration papers aren't necesarrily a requirement for ownership. If we don’t have registration papers when puppy is being tendered we cannot guarantee with 100% certainty the puppy will have papers. In those small rare cases, we have been able to reach a financial reimbursement amount to make customers happy.
Date of birth on registration papers will always be the correct DOB. When waiting on papers, breeders can sometimes provide us dates of birth (DOB) written/verbally and a mistake can happen. The DOB on the printed out registration form is correct and the DOB received at time of purchase is approximate until the physical registration papers are in hand with one of our team members.
Simply Southern Pups has no official affiliation with AKC, ACA, NPCR or CKC and take no responsibility for their actions or lack thereof. We are a customer of those registration firms just like other breeders are.
Refunds
All refunds are processed within 15 days of customer request; the process can take 5-10 days to post to your financial institution. We do not offer refunds for retro-active vet bills, pet returns nor shipping charges as all sales are final. We only offer a replacement puppy per our warranty.
Health Certificates
All puppies which are sent via airlines have a health certificate that MUST be present at the airport upon rendering the pup. If you, or the airline representative, lose or misplace the white/pink health certificate, please send us an email or call us. We can supply a computerized shot record to you. Please allow us up to 3 days to provide you this information. For puppies being picked up locally, or delivered by car a Health Certificate is not required.
Weight Guarantee & Use of term "TEACUP"
Simply Southern Pups uses the term "TEACUP" to simply refer to smaller breed puppies. If you are searching for a dog with a specific size, please purchase one of our puppies where we may offer a specific weight guarantee. The term "TEACUP" does not mean that the puppy stays under a specific weight at full grown size and should not be assumed the word means we gaurantee a certain size. Pups with a size guarantee oftentimes are priced higher due to the risk we are taking on guaranteeing something which can change off many factors outside our control.
Breeding Rights and Pet Quality
We only rehome our puppies with the intention of them being a family PET, not to be bred. In the <0.1% chance you are a qualified and experienced breeder with breeder intentions, it's understood you will make those intentions known to us before placing a hold or picking up the puppy. We qualify breeders first and don't take any breeders into our program who are just starting. If you have had 3 or more litters, and want to be a part of our program, we also need to do an extra Vet check and charge a breeding rights fee (Normal fees are $250-$1000 depending on breed & gender). Formal Spay/Neuter contracts on paper are a somewhat dated approach to limiting bloodlines because now the same thing can be done with a registration PIN on AKC paperwork. A breeding rights discussion before your purchase is required to avoid the surprise the pup's registration can limit the furthering of bloodlines. We also do not guarantee any pup will be good for breeding now or in the future --even with a healthy Vet check. Things change, dogs change, Vet opinion changes. No one can look at a puppy and know if the dog will be a good adult dog to breed. We also pre-screen our families wanting to breed in future witht a face-to-face interview to discuss breeding experience & breeding goals. Because of the aforementioned, we do not do any sort of discount pricing for breeders & must charge a breeding rights fee on top of the listed pet price. 99% of families are purchasing a pup for a family pet, and the lion share of our customers fall into this category.
Breeding Specific Traits /Limitations of toy or mini breeds
Dog breeds tend to have signature traits: Border collies love to herd, greyhounds love to chase, and German shepherds make good guard dogs. There are also physical traits inherited which let you know you have the right breed in hand. For instance, there aren't too many French Bulldogs or English bulldogs with long noses. There aren't too many of those two breeds with overbites as well :) A breed specific trait is something you know is there, just by being with the dog for minutes, or seeing it with your own eyes. Traits like these are highly heritable and should never be considered a negative thing caused by bad breeding. When you are buying a mini/toy breed there are some characteristics which are more common than larger counterparts (i.e. small breeds have higher instances of teeth misalignment, hernias, cryptorchid testicles, recessed vulvas and luxating patellars). These issues can pop up at any point in a dog's life....although most are produced in their juvenilie stage of development (0-12 months). Juvenile issues like the above mentioned are a normal gamble on owning a dog and these instances are never grounds for a reimbursement. You can submit any claims to a Pet Insurance provider if you are unhappy with the more common instances due to owning a mini/toy. Another breed specific characteristic would be a Shih Tzu or ShihTzu mix having an underbite. Shihtzu's are notorious for having cute underbites and because of this it is considered a breed characteristic rather than a defect. The breed standard for Shih Tzus acknowledges the possibility of a slight underbite, and it is not usually considered a cause for concern in terms of the dog's health or well-being.
Hereditary And Congenital Disorders
All puppies are checked by Veterinarians for the major hereditary and congenital disorders before leaving our care. This is a nose to tail check where the heart, eyes, lungs, knees, bodyweight, etc are checked to make sure there is nothing to note. In addition it is our club policy the parents of our puppies have also been checked to be free and clear of any major disorders as well. If a genetic issue pops up it can sometimes simply be a faulty genetic code of one dog & not an anomaly set forth by the parents. Issues have arisen in puppies before which were never present in the parent bloodline. Small breed puppies are prone to disorders such as knee failure and liver failure due to their size or breed risks. Though the risk is minimal, small breed puppies can have a slightly increased amount of certain genetic disorders due to their small make-up.
Pup Availability Date/ Take home date:
All puppies listed on our site will have a TENTATIVE take home or available date which is listed on the pup's ad & can change if a puppy isn't meeting their milestones. We have bred for over 20 years and thru the experience of our dog club, we know what time is right for EACH INDIVIDUAL puppy to go home. Some smaller maltese & maltese mixes tend to be our number one concern however there are also some other breeds which can cause us pause as well. We want you to know your puppy is in GOOD HANDS and if we time the transition right for the puppy to be rehomed, you will have an A+ experience. Whenever a family doesn't allow these take home windows to adjust, we should have options for OTHER bigger dogs you can swap to, or available earlier. However if you want the pup you selected we resrve the right to rehome them when we see fit.
Right of Refusal
We had a 4 page pre-adoption questionnaire we sent to families adopting for years and years. That process became too cumbersome and didn't work the way we had hoped because families would simply call us and ask us what they were supposed to put down. It created more problems than solved, so we resorted back to phone calls & verification via calls & meet and greets. We look at adoptions as we do a marriage both sides need to agree at each point during the adoption. We do reserve the right to sell a puppy to the best fitting family, not necessarily the family who simply has the money. We operate like an adoption agency and we want PEACEFUL transactions where both sides agree it will act with every intent towards goodwill moving forward.
Legal Jurisdiction
When purchasing your new puppy from Simply Southern Pups, we ask you agree to our warranty policy in its entirety prior to checking out as well as our terms of use prior to entering payment information. As a part of that guarantee and terms of use, you are stating that you understand that any civil action against Simply Southern Pups must take place in the state of South Carolina in Newberry County.

Use of this website, and information distributed in conjunction with this website, is offered to you on your acceptance of these Terms of Use, our Privacy Policy and other notices posted on this website. Your use of this website, or of any content presented in any and all areas of the website, indicates your acknowledgment and agreement to these Terms of Use, our Privacy Policy and other notices posted on this website. If you do not agree to be bound by and comply with all of the foregoing, you may not access or use our puppy information, services, or website.

On the final screen of our checkout process you will need to check the box agreeing to the terms of the sale prior to entering your credit card information.
Adult Size & Weight Estimates
We are providing estimated adult weights on all our dogs based on parents' size, breed history, litter size and age at 8 weeks. Please understand that when you are purchasing a mix breed dog, especially one between a larger breed and a smaller breed, the puppy has the possibility to take heavily after one parent. Sometimes when the puppy reaches adult size it may be smaller or larger than the estimates provided. If weight and size is a major concern, please stick with a small breed dog where both parents are under the weight you desire.
Hereditary And Congenital Disorders
Please understand that all puppies sold by Simply Southern Pups have been checked for the above disorders prior to leaving our facility. On top of the puppies being checked by the vet, the parents of the puppies have been checked to be free and clear of any disorders. By purchasing a small breed puppy you are putting yourself at risk for disorders such as knee failure, hip failure, and liver failure. Though this risk is minimal, we do want you to understand that small breed puppies can have disorders due to their small make-up. For this reason we provide a Health Gaurantee and offer pet insurance.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SIMPLY SOUTHERN PUPS, INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, SUCCESSORS, ASSIGNS OR AFFILIATES (COLLECTIVELY, THE "COVERED PARTIES") BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH ANY USE OF THIS SITE OR WITH ANY DELAY OR INABILITY TO USE A SITE, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS OR SERVICES OBTAINED THROUGH THIS SITE, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO CERTAIN USERS. IN NO EVENT SHALL THE COVERED PARTIES' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT, INCLUDING BUT NOT LIMITED TO NEGLIGENCE) ARISING FROM THIS AGREEMENT OR YOUR USE OF THE SITE EXCEED THE AMOUNT PAID BY YOU TO PREMIER PUPS IN THE TRANSACTION IN QUESTION OR IF NO TRANSACTION IS AT ISSUE, IN THE PRECEDING TWELVE (12) MONTHS.
Agreement to Mandatory Individual Arbitration
PLEASE READ THIS CAREFULLY AS IT AFFECTS YOUR RIGHTS. INSTEAD OF SUING IN COURT, YOU AND SIMPLY SOUTHERN PUPS AGREE EXCLUSIVE MEANS OR RESOLVING ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF, OR RELATING TO, THESE TERMS OF USE OR ANY APPLICABLE PRIVACY POLICY, YOUR USE OR INABILITY TO USE THE SITE, ANY PURCHASE MADE THROUGH THE SITE OR ANY CONTACT WITH PREMIER PUPS OR ITS EMPLOYEES, CONTRACTORS OR AFFILIATES OR OTHERWISE ARISING OUT OF YOUR RELATIONSHIP OR INTERACTION WITH SIMPLY SOUTHERN PUP, SHALL BE BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ON AN INDIVIDUAL BASIS. THERE IS NO JUDGE OR JURY IN ARBITRATION, AND COURT REVIEW OF AN ARBITRATION AWARD IS LIMITED. YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND SIMPLY SOUTHERN PUPS ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS OR REPRESENTATIVE ACTION OR OTHER CLASS PROCEEDING. YOU AND SIMPLY SOUTHERN PUPS FURTHER AGREE AS FOLLOWS:
- This agreement to arbitrate is intended to be broadly interpreted, and includes, but is not limited to: (1) disputes and claims arising out of or relating to any aspect of the relationship between You and SIMPLY SOUTHERN PUPS, whether based in breach of contract, breach of any guarantees or warranties, tort, statute, fraud, misrepresentation or any other legal theory; (2) claims that arose before this Agreement or any prior agreement (including, but not limited to, claims relating to advertising); (3) claims that may arise after the termination of Your relationship with Simply Southern Pups; and (4) claims that are currently the subject of purported class action litigation in which You are not a member of a certified class.
- You and Simply Southern Pups hereby agree that the Federal Arbitration Act ("FAA") applies to any arbitration, and governs all questions of whether a dispute is subject to arbitration. Unless You and Simply Southern Pups agree otherwise in writing, arbitration shall be: (i) administered by the American Arbitration Association ("AAA"), pursuant to the Consumer Arbitration Rules then in effect (the "AAA's Rules"); and (ii) conducted by a single arbitrator who is licensed to practice law. The AAA's Rules can be found at www.adr.org. You can call AAA at 800-778-7879 to obtain more information.
- THIS AGREEMENT DOES NOT ALLOW CLASS ARBITRATIONS EVEN IF THE PROCEDURES OR RULES OF THE AAA WOULD. RATHER, YOU AND Simply Southern PUPS ARE ENTITLED TO PURSUE ARBITRATION ONLY ON AN INDIVIDUAL BASIS. FURTHER, AND UNLESS YOU AND PURCHASER AGREE OTHERWISE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE INDIVIDUAL PARTY'S CLAIMS WITH ANY OTHER PARTY'S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR COLLECTIVE PROCEEDING.
- You and Simply Southern Pups each are responsible for their respective costs relating to counsel, experts, and witnesses.
- This arbitration agreement does not preclude You or Simply Southern Pups from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against on a party's behalf. In addition, and notwithstanding the other provisions of this arbitration agreement, either party may bring an individual action in small claims court.
- If You or Simply Southern Pups fail to comply with this arbitration provision, said breaching party shall be liable for the costs and attorneys' fees incurred by the other party in enforcing compliance with the arbitration agreement.
- Unless the AAA arbitrator rules otherwise, all claims or counterclaims shall be resolved by the submission of documents only / desk arbitration (see R-29 of the AAA's Rules). Any party, however, may ask for a hearing. The arbitrator also may decide that a face-to-face hearing is necessary. Any hearing, however, that is not held by telephone, shall take place in Newberry, SC unless the AAA arbitrator decides otherwise.
- Small Claims Option: You may also litigate any Dispute in Small Claims Court in Newberry County in the State of South Carolina. if your claim meets all requirements to be heard in the small claims court. However, if you initiate a Small Claims case, you are responsible for all your court costs.
- Any proceeding to enforce this arbitration agreement, including any proceeding to confirm, modify, or vacate an arbitration award, may be commenced in any court of competent jurisdiction. In the event that this arbitration agreement is for any reason held to be unenforceable, any litigation against Simply Southern Pups (except for small-claims court actions) may be commenced only in the federal or state courts located in Newberry County, South Carolina. You hereby irrevocably consent to the jurisdiction of those courts for such purposes.
Amendment to Terms of Use
Simply Southern Pups reserve the right, at our sole discretion, to change, modify or otherwise alter the Terms of Use at any time. You agree that we may modify the Terms of Use and such modifications shall be effective immediately upon posting. You agree to review these terms and conditions periodically to be aware of modifications. Continued access or use of the Site following such posting shall be deemed conclusive evidence of your acceptance of the modified Terms of Use except and to the extent prohibited by applicable state or federal law.
